What are employment claims?

An employee or a former employee from your business can make a claim to an employment tribunal due to unlawful treatment at work, such as:

  • Unfair dismissal
  • Discrimination and harassment
  • Unfair deductions from their pay

When the claimant (your employee) wishes to make a claim to the respondent (you), ACAS first offers what is called an early conciliation process. This is a chance to resolve the dispute outside the tribunal. A tribunal usually happens after an early conciliation certification has been issued by ACAS—proving that the early conciliation between you and your employee ended without an agreement.

You can usually know the start of a tribunal case when you receive a claim form, also known as the ET1 form, from your employee. Since there is a strict time limit for you to prepare your defense, it is vital that you take immediate action.
