TUPE Procedure

What is a TUPE Procedure?

TUPE stands for Transfer of Undertakings (Protection of Employment). It consists of regulations you have to meet when you wish to change the owner of your business. This could mean a merging of two companies, or simply a transfer from one employer to another. TUPE guarantees that the employees are not unfairly dismissed in the process and that the terms of employment are also successfully transferred.

As an employer, it is important that you are fully aware of the TUPE process. If you do not handle a TUPE transfer properly, it could mean you are violating basic employee rights. An employee or a former employee can then bring a claim against you. If you are making the transfer, you must provide certain information about your employees to the new employer. If you are the new employer taking on the transfer, you must be aware of the previous employment conditions, redundancy rights, and other regulations under TUPE.
